Terms and Conditions of Use for Visitors
This web site (the "Site") is owned and operated by Design Latitudes ("DL") (formerly David Curry Design) for your personal information, education, communication, entertainment, and enjoyment. Please feel free to browse the Site; however, your access and use of the Site is subject to the following conditions of use and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Site Terms & Conditions of Use.
All Content presented herewith is provided on an "As Is" basis, without warranty or the implication thereof. Neither DL nor the individuals associated with the preparation or hosting of the Site shall have any liability to any person or entity with respect to liability, loss, or damage caused or alleged to be caused directly or indirectly by the Content contained within the Site.
Visitors may not use language that is threatening, abusive, vulgar, discourteous, or criminal. Visitors also may not post or transmit information or materials that would violate rights of any third party or which contain a virus or other harmful component. Visitors may not under any circumstance attempt to make an unauthorized visit to any part of the Site or the Site server or any related components of the Site that are not linked directly to the public Site pages by any means other than the arrow buttons or by a visible link. Violators of these admonitions may be criminally prosecuted.
DL clients ("the Clients") included on the Site are defined solely as "the party for which professional services were rendered." DL makes no representation either express or implied as to the extent of the Client relationship, the business or finances involved, the outcome or disposition of the project, its ultimate use or users, or the nature and extent of any contract(s) or compensation. DL has had direct contact and/or received direct instructions and input from each Client, unless credited otherwise.
DL is the sole author of all the Content shown on the Site unless credited otherwise, and maintains the sole right of copyright, derivative rights and unrestricted usage for any purpose whatsoever. In addition to the rights of authorship, DL also may make use of the Content in any forum whatsoever, which may incorporate editorial or critical commentary under the "Fair Use" doctrine of copyright law. All the Content shown on the Site has been made for public consumption and none has ever been deemed "confidential." All models shown on the Site were 18 or over at the time of shooting and have signed unconditional models' releases in perpetuity.
None of the Content has been created under any "Work for Hire Agreement" and at no time has David Curry, or Marjorie Carmelia, principals of DL, nor any employees of DL ever been employed by any of the Clients on the Site. DL has served solely as an independent contractor with all of the Clients.
DL permanently keeps and maintains historically accurate, archival quality documentation (the "Documentation") of all Content authored by DL, including but not limited to original art, master art, computer files, Client documents, correspondence, photographs, photographic documentation and alternative concepts not accepted by the Client. The Documentation has been used without restriction or qualification for the purposes of developing the Site, marketing, resume(s), Client list(s), self-promotion, and general career development. No Clients have ever sought prior approval on the use of such Documentation nor has DL ever been directed to not maintain such Documentation or to destroy any Content samples.
All photography displayed on the Site has been created and copyrighted by David Curry d.b.a. DL unless otherwise credited. Original concepts and art direction on all projects are by David Curry.
From 1988-1999 LetterSpace® has been a registered trademark of DL. As of June 25, 1999 LetterSpace® has become a registered trademark of Mr. Garrett Boge d.b.a LetterPerfect. All other trademarks and tradenames appearing on the Site are tradenames of their respective owners.
DL works in a professional manner that is an established and accepted norm for the design business in which it is gainfully employed. These accepted norms are stridently embraced by the American Institute of Graphic Arts (AIGA) and the Graphic Artists Guild (GAG).
DL recognizes the privacy concerns of visitors to the Site on the Internet and the importance of protecting the privacy of personally identifiable information collected about its visitors. As a general policy, no personally identifiable information is automatically collected. Personally identifiable information, such as a visitor's name, company, or e-mail address, is collected only when knowingly and voluntarily submitted. DL uses such information only for the purpose for which it is submitted unless we disclose other uses at the time of collection.
DL does not transfer or sell personally identifiable information or demographic data collected at the Site to third parties. However, DL may share personally identifiable information with other parts of our company. DL is not responsible for the practices of any third party sites which link to or from the Site. Inclusion on the Site of any institution, company, or individual is not an endorsement by DL. Visitors to those sites should refer to their separate privacy policies and practices.
If you are under the age of 18, you must get permission from your mom or dad before you do any of the following on or through the Site:
1.) Send any information about yourself or others
2.) Buy anything
If you get permission from your mom or dad to submit your name to be publicly posted on the Site, you should never use your full name. Just submit your first name or initials.
DL encourages parents to supervise their children's activities online and to participate with their children whenever possible.
